1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of the PhoneValidatorUSA.com website and the phone validation, batch processing, DNC screening, API, subscription, and related services provided by PhoneValidatorUSA ("PhoneValidatorUSA," "we," "us," or "our").

By accessing or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use our services.

2. Description of Services

PhoneValidatorUSA provides services that may include phone number validation, phone line type identification, carrier and location information, DNC status checking, batch phone list processing, and API-based phone validation.

The information and features available may vary depending on the service or plan selected.

3. Individual Phone Validation

Our individual validation service allows users to submit US phone numbers for real-time validation and available phone-data results.

Results may include phone validity, line type, carrier, location, and DNC status.

4. Batch Phone Validation

Customers may upload CSV files containing phone lists for batch processing.

Customers are responsible for ensuring that the phone numbers and other information submitted through the service may lawfully be processed and that they have the necessary rights or authorization to submit the information.

5. Unlimited Access

Unlimited Access allows customers to process phone lists without a separate charge for each list during the active subscription period.

"Unlimited" refers to the absence of a per-list or per-batch processing charge. It does not authorize abusive, fraudulent, automated, or otherwise prohibited use of the service.

We reserve the right to restrict or suspend accounts involved in excessive activity that materially impacts service availability, system security, or other customers.

6. Pay-As-You-Go Processing

Pay-as-you-go processing allows customers to process phone lists without an Unlimited Access subscription. Charges are based on the number of phone numbers processed according to the applicable pricing at the time of purchase.

7. Payments

You agree to provide accurate payment and account information when purchasing our services.

Payments may be processed through third-party payment providers. Additional terms from the applicable payment provider may apply.

Prices and applicable charges are presented before payment is completed. By completing a purchase, you authorize the applicable payment provider to process the transaction.

8. Subscriptions

Subscription services provide access to the features and usage described for the applicable Unlimited Access subscription plan.

Your subscription remains active according to the subscription period, billing terms, and cancellation terms presented when you subscribe.

Cancelling a subscription does not necessarily terminate access immediately when a paid subscription period remains active. Access may continue through the applicable paid period unless otherwise stated.

Subscription cancellation does not necessarily entitle you to a refund for a previously completed billing period or services already provided, except where required by applicable law or expressly stated otherwise.

9. API Access

Our API allows developers to integrate phone validation and DNC status checking into their own applications and systems.

API users are responsible for protecting their API credentials and for activity performed using their credentials.

API access may be subject to subscription requirements, prepaid credits, usage limits, pricing, or other conditions specified in the applicable API documentation or service plan.

10. Acceptable Use

You agree to use the service only for lawful purposes and in accordance with these Terms.

You must not:

• Use the service for fraudulent or unlawful activities.
• Attempt to gain unauthorized access to our systems.
• Interfere with the operation, availability, or security of the service.
• Attempt to circumvent usage limits or payment requirements.
• Use automated methods in a manner that places an unreasonable load on our systems.
• Share, expose, or misuse API credentials.
• Submit information that you do not have the right or authorization to process.
• Use the service in a manner that violates applicable laws or regulations.

11. DNC Information

PhoneValidatorUSA may provide DNC status information based on applicable registry data available to the service at the time of the check.

A DNC flag is an informational result indicating that a phone number matched the DNC data used by the service at the time it was checked.

DNC information is provided to help customers identify phone numbers that may require additional consideration before calling.

DNC results do not constitute legal advice and do not determine whether a particular call, text message, or other communication is legally permitted.

You are responsible for understanding and complying with all laws, regulations, rules, and requirements applicable to your calling, messaging, marketing, or other use of telephone numbers.

12. Accuracy of Results

We make reasonable efforts to provide useful and current phone validation and screening information. However, phone numbers, carriers, line types, locations, and registry information can change.

Accordingly, we do not guarantee that every result will always be complete, current, or error-free.

A validation result should be treated as information provided by the service and not as an absolute guarantee regarding the current status or future use of a phone number.

13. Customer-Submitted Data

You retain responsibility for the information you submit to the service.

By submitting a phone list or other information, you represent that you have the appropriate rights, permissions, or authorization necessary to submit the information for processing.

14. Confidentiality of Uploaded Lists

We are committed to protecting the confidentiality of customer phone lists.

Uploaded phone lists are used to provide the requested processing service and are permanently deleted from our server after the applicable processing workflow has been completed.

We do not retain customer-uploaded phone lists for future processing, advertising, marketing, or unrelated commercial purposes.

15. Processing Results

Results generated through our services may contain information such as validation status, line type, carrier, city, state, and DNC status.

Customers are responsible for reviewing and using processing results appropriately and in accordance with applicable laws and regulations.

16. Intellectual Property

The website, software, service design, documentation, trademarks, logos, and other materials provided by PhoneValidatorUSA are owned by or licensed to us and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works from our service except where expressly permitted by law or by written authorization.

17. Service Availability

We strive to maintain reliable service availability but do not guarantee uninterrupted or error-free operation.

The service may occasionally be unavailable due to maintenance, upgrades, technical problems, security events, third-party dependencies, or circumstances outside our reasonable control.

18. Account Suspension or Termination

We may suspend or terminate access to an account when reasonably necessary to protect our service, users, systems, or third parties, including in cases involving fraud, abuse, unauthorized access, payment issues, or violations of these Terms.

We may also restrict access when necessary to protect the availability, performance, or security of the service.

19. Refunds

Refund eligibility depends on the service purchased, the circumstances of the request, and any applicable refund policy presented at the time of purchase.

Nothing in these Terms is intended to exclude rights or remedies that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, PhoneValidatorUSA will not be responsible for indirect, incidental, special, consequential, or similar damages arising from the use of or inability to use the service.

The service is provided as a phone validation and screening tool. You remain responsible for decisions made using information obtained through the service.

21. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, or expenses arising from your misuse of the service, your violation of these Terms, or your submission or use of information in violation of applicable rights or laws.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices, or legal requirements.

The updated version will be posted on this page with a revised "Last Updated" date.

Your continued use of the service after changes are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.

23. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the parties and the applicable jurisdiction, without regard to conflict-of-law principles, except where applicable law requires otherwise.
